Terms of Service
Effective Date: 01/01/2026
Last Updated: 07/21/2026
1. Agreement to Terms
These Terms of Service (“Terms”) are an agreement between you and Olmstead Properties, LLC (“Company,” “we,” “us,” or “our”) governing your access to Olmstead.Properties (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. Current Business and Site Scope
Olmstead Properties manages, markets, finances, and sells land assets. We are not actively marketing or soliciting for new acquisitions, but we may evaluate unsolicited opportunities case by case. We also work alongside Olmstead Lending to manage and dispose of property obtained through note workouts, deed-backs, or foreclosure. The Site provides company information, links to available land, a contact channel for current business or unsolicited opportunities, and access to company updates.
Older interviews, articles, and third-party pages may describe a more active land-acquisition strategy. Those historical descriptions do not mean Olmstead Properties is currently running an acquisition campaign or inviting broad seller solicitation.
3. Eligibility
You must be at least 18 years old and capable of entering a binding contract to use transaction-related Site features. By using those features, you represent that you meet these requirements.
4. Property Listings and Information
IMPORTANT: Property information is provided for general informational purposes. Although we work to keep it accurate, we do not guarantee the accuracy, completeness, or reliability of boundaries, acreage, dimensions, zoning, permitted uses, access, roads, easements, utilities, flood information, environmental conditions, taxes, assessments, photographs, maps, availability, or other property details.
Information can change without notice. Prospective buyers are responsible for independent due diligence and should consult qualified professionals before making a purchase decision.
5. No Binding Offer
Nothing on the Site is a binding offer to buy or sell property. Listings are invitations to inquire and may be changed, sold, or withdrawn without notice. A binding property agreement exists only when a written agreement is executed by all required parties. An unsolicited submission concerning land that Olmstead does not own does not create an obligation to review it, respond, negotiate, or make an offer.
6. Principal Capacity; No Professional Advice
When Olmstead Properties sells or administers land, it acts as a principal or owner-side operator, not as a real estate broker or agent for a Site visitor. Site content is not legal, tax, financial, investment, engineering, surveying, environmental, or real estate advice. Consult qualified professionals for advice about your circumstances.
7. Related Companies and Third-Party Services
The Site may link to Own Property Today, Olmstead Lending, listing platforms, media pages, maps, public records, and other third-party or related-company sites. Their content, transactions, offerings, privacy practices, and terms are separate from this Site and are governed by the terms shown on those sites. Nothing on this Site is an offer to sell a security or a statement of current investment terms.
8. User Submissions and Inquiries
When you submit information, you agree to provide information that is accurate and that you are authorized to provide. You permit us to respond using the contact information you supplied and, when reasonably needed to address your request, to route it to the appropriate related business or service provider. Any transaction remains subject to separate written agreements.
9. Intellectual Property
The Site and its content, features, designs, text, graphics, logos, photographs, and software are owned by the Company or its licensors and are protected by applicable intellectual-property laws. Except for personal, noncommercial use, you may not reproduce, distribute, modify, publicly display, republish, download, store, or transmit Site materials without prior written permission.
10. Prohibited Uses
You may not use the Site to violate law; submit false, misleading, fraudulent, malicious, or infringing material; impersonate another person; interfere with the Site or its security; introduce malware; scrape or harvest data in violation of law or posted controls; or exploit Site content for an unauthorized commercial purpose.
11. Third-Party Links
We are not responsible for the content, accuracy, availability, security, or practices of third-party sites. Access to third-party sites is at your own risk and subject to their terms.
12. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
WE SPECIFICALLY DISCLAIM ANY WARRANTY ABOUT THE ACCURACY OF PROPERTY LISTINGS, DESCRIPTIONS, BOUNDARIES, MAPS, OR OTHER PROPERTY INFORMATION. VERIFY MATERIAL INFORMATION INDEPENDENTLY.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO THE SITE OR RELIANCE ON SITE CONTENT.
To the maximum extent permitted by law, our aggregate liability for claims arising from or relating to the Site will not exceed $1,000. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
14. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, violation of these Terms, violation of another person’s rights, or information you submit.
15. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules. Arbitration shall take place in Maricopa County, Arizona, before one arbitrator. Judgment on the award may be entered in a court with jurisdiction.
You and the Company agree that arbitration will proceed only on an individual basis, not as a class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over a class or representative proceeding.
Either party may bring an individual action in a qualifying small claims court in Maricopa County, Arizona. The Company will pay AAA filing, administration, and arbitrator fees for arbitration initiated by you, except that you are responsible for the first $250 or the applicable Maricopa County small-claims filing fee, whichever is less. This section survives termination of these Terms.
16. Governing Law
Arizona law governs these Terms without regard to conflict-of-law principles. For disputes not subject to arbitration, you consent to the jurisdiction of state and federal courts located in Maricopa County, Arizona.
17. Communications
By submitting a Site form, you permit us to respond to that inquiry using the information provided. Any separate consent language shown with a form, newsletter, call, or text governs that communication. You may opt out of marketing email through its unsubscribe link and of eligible text messages by replying STOP. Standard message and data rates may apply.
18. Changes; Termination
We may update these Terms by posting a revised version and changing the “Last Updated” date. We may suspend or terminate access to the Site as permitted by law.
19. Severability and Entire Agreement
If a provision is held unenforceable, the remaining provisions remain effective. These Terms and the Privacy Policy are the entire agreement concerning use of this Site. They do not replace a separate signed agreement governing an actual property, servicing, or recovery transaction.
20. Contact
Questions about these Terms may be submitted through the contact page.
